Teilnahmebedingungen und Datenschutzhinweis für Gewinnspiele

Teilnahme und Ablauf

Die Teilnahme an Gewinnspielen der ecom Gmbh (Am Großen Teich 2, 58640 Iserlohn)
richtet sich ausschließlich nach den folgenden Teilnahmebedingungen:
● Teilnahmeberechtigt sind natürliche Personen mit einem Mindestalter von 18 Jahren.
● Mitarbeiter:innen der ecom GmbH und deren Angehörige sind von der Teilnahme
ausgeschlossen.
● Jede Person kann nur einmal teilnehmen.
● Die Ermittlung der Gewinner:innen erfolgt im Rahmen einer auf dem Zufallsprinzip
beruhenden Verlosung unter allen Teilnehmer:innen.
● Umtausch, Barauszahlung oder Übertragung auf Dritte sind ausgeschlossen.
● Die ecom GmbH behält es sich darüber hinaus vor, Gewinnspiele ohne vorherige
Ankündigung und ohne Mitteilung von Gründen zu beenden oder mit Blick auf die
Gestaltung oder besondere Bedingungen zu ändern.
● Mit der Teilnahme an einem Gewinnspiel der ecom GmbH erkennt der:die
Teilnehmer:in diese Teilnahmebedingungen ausdrücklich an.

Gewinne, Aufgabenstellung, Teilnahmezeitraum

● Verlost werden 2 Amazon Warengutscheine im Wert von jeweils 250,00 €.
● Die Dauer des Gewinnspiels erstreckt sich vom 22.04.2021 bis zum 06.05.2021.
● Die Teilnahme erfolgt durch Zusendung der E-Mail Adresse über das Umfragetool.
● Jede Person kann nur einmal teilnehmen.
● Die Ermittlung der Gewinner:innen erfolgt im Rahmen einer auf dem Zufallsprinzip
beruhenden Verlosung unter allen Teilnehmer:innen. Die Gewinner:innen werden
spätestens eine Woche nach Beendigung des Gewinnspiels per E-Mail bekannt
gegeben und benachrichtigt.
● Die Gewinner:innen haben sich per E-Mail unter Angabe des Vor- und Nachnamens
und der Adresse bei ecom zu melden. Wenn sich die Gewinner:innen nicht innerhalb
von 7 Tagen nach Bekanntgabe per E-Mail melden, verfällt der Gewinnanspruch.
● Der Versand des Gewinns erfolgt postalisch oder per E-Mail – spätestens 14 Tage
nach Bekanntgabe der Gewinner:innen. Umtausch, Barauszahlung oder Übertragung
auf Dritte sind ausgeschlossen.
● Der Teilnehmer:innen werden darauf hingewiesen, dass die Teilnahme am
Gewinnspiel ausdrücklich die Teilnahme an der Kund:innenbefragung
voraussetzt. Ohne Durchführung der Kund:innenbefragung besteht daher kein
Anspruch am Gewinnspiel.

Datenschutzhinweis

● Die ecom GmbH nutzt die per E-Mail erhaltenen personenbezogenen Daten der
Gewinner:innen (Name und Adresse) ausschließlich für die Übermittlung des
Gewinns. Sämtliche nutzer:innenbezogenen Daten werden in den Systemen von
ecom nach Abschluss des Gewinnspiels gelöscht. Mit Ausnahme der Daten der
Gewinner:innen. Die nach Handels- und Steuerrecht erforderlichen Informationen des
Vertragsverhältnisses werden bis zum Ablauf der gesetzlichen
Aufbewahrungspflichten aufbewahrt.
● Es erfolgt keine werbliche Nutzung. Rechtgrundlage für die Verarbeitung ist Art. 6,
Abs. 1 lit. b, DSGVO, d.h. die Teilnehmer:innen stellen ecom die Daten auf Grundlage
des Vertragsverhältnisses zwischen Ihnen und ecom zur Verfügung.
● Die mitgeteilten Daten werden ausgewertet von Fa. Ways GmbH. Der:die
Teilnehmer:innen erteilen hiermit ausdrücklich sein:ihr Einverständnis, dass
seine:ihre Daten zum Zwecke der Durchführung für das Gewinnspiel übermittelt
werden.

Conditions of participation and data protection notice for competitions

Participation and procedure

Participation in competitions organised by ecom Gmbh (Am Großen Teich 2, 58640 Iserlohn)
is governed exclusively by the following conditions of participation:
● Natural persons with a minimum age of 18 years are eligible to participate.
● Employees of ecom GmbH and their relatives are excluded from participation.
● Each person can only participate once.
● The winners will be determined by a random draw among all participants.
● Exchange, cash payment or transfer to third parties are excluded.
● Furthermore, ecom GmbH reserves the right to terminate competitions without prior
notice and without giving reasons or to change the design or special conditions.
● By participating in a competition organised by ecom GmbH, the participant expressly
accepts these conditions of participation.

Prizes, task, participation period

● 2 Amazon gift vouchers worth € 250.00 each will be raffled off.
● The duration of the competition is from 22.04.2021 to 06.05.2021.
● Participation takes place by sending the e-mail address via the survey tool.
● Each person can only participate once.
● The winners will be determined by a random draw among all participants. The
winners will be announced and notified by e-mail no later than one week after the end
of the competition.
● The winners must contact ecom by e-mail, stating their first and last name and
address. If the winners do not contact us by e-mail within 7 days of notification, they
will forfeit their claim to the prize.
● The prize will be sent by post or e-mail – at the latest 14 days after notification of the
winner. Exchange, cash payment or transfer to third parties are excluded.
● Participants are reminded that participation in the competition expressly requires
participation in the customer survey. Without completion of the customer survey,
there is therefore no entitlement to participate in the competition.

Data protection notice

● ecom GmbH will use the personal data of the winners (name and address) received
by e-mail solely for the purpose of transmitting the prize. All user-related data will be
deleted from ecom’s systems after completion of the competition. With the exception
of the data of the winners. The information on the contractual relationship required
by commercial and tax law will be retained until the expiry of the statutory retention
obligations.
● The data will not be used for advertising purposes. The legal basis for the processing
is Art. 6, Para. 1 lit. b, DSGVO, i.e. the participants provide ecom with the data on the
basis of the contractual relationship between them and ecom.
● The data provided will be evaluated by Ways GmbH. The participant hereby expressly
gives his/her consent for his/her data to be transmitted for the purpose of carrying
out the competition.
